Legal Question in Family Law in New York

obtaining a copy of a divorce

my spouse obtained a divorce from me in NY in august 2007. I have not received my copy of the divorce despite repeated calls to the lawyer. I can't get past his secrectary who claims she is mailing them out right away but she never does it. How do I get this lawyer to send me my copy of the divorce? Or can I get them directly from the court? I live in Texas which makes is impossible to collect them in person.

Thank you for your response

Re: obtaining a copy of a divorce

First I would go to e-law.com and look up your case. You can search either by name or by index number. If the case says "Disposed" it probably means that the Judgment was signed.

I would then contact e-law, tell them that you want a copy of the Judgment. The file for a divorce action is sealed and only a litigant and his or her attorney is able to copy the contents of the file. The people at e-law will tell you what they need to obtain a certified copy of the Judgment.

Mike.
