Legal Question in Family Law in New York

OK,my daughter has primary custody,because baby's father has not passed last 2 drug tests,a supervised visit was set up but he did'nt show up,in the mean time my daughter got charged with petty larceny less than 20.00(i no this was stupid on her part)how will this affect her custody case?she was ror'd not bailed out???????????/do we need a lawyer asap?

That depends on if the father files a petition for custody. If he does then this may be considered but it is not determinative, each case is determined using the standard "the best interests of the child" which entails a cumulative look at other facts.
