Legal Question in Family Law in New York
Order of Protection
I had an order of temporary order of protection put on me from an Aunt. The judge extended it for six months. I misrepresented myself and believe the order is unecessary. I believe I have information that could change his decision.
Can I move to have this reconsidered or is it too late and I must live with this?

Re: Order of Protection
You can always ask the court to reconsider
based upon new evidence, etc.
But if this is simply a family court proceeding
without any criminal finding, but merely
the issuance of the stay away order, the
easier course of action is to stay away for
six months. There is no permanent criminal
record and so no need to fight that vigorous
but accept the path of least resistance which
does not adversly affect the future
Re: Order of Protection
No. It can be fought. Call me. Most orders of protection are bogus legal moves by women to short-circuit child visitation orders and to punish men.
