Order to appear
I am a 27 year old woman with a 3 year old child. The childs father, to whom I was never married, has been incarcerated in the Indiana correctional facility for the past 2 years. I have received an order to appear in Indiana, The hearing is to determine if I have an obligation to take my son to the facility for visitation. There have never been any valid visitation orders. This would be an economic hardship for me as I have no car and would have to take 2 days off from work to appear. Do I have to show up for this hearing?

I am not admitted in Indiana, so I cannot tell you definitively if you must go. I would re-pose your question to LawGuru so it goes to an Indiana attorney.
I can tell you, however, that it is NEVER a good idea to not show up for a court date.

I need more information:
1. Where was the residence of the father before he was incarcerated?
2. Where was the residence of the child before the father was incarcerated?
3. Where was your residence before the father was incarcerated?
4. Where is your present residence and the residence of the child.
