Legal Question in Family Law in New York

outdated divorce proceedings

my fiance's wife committed adultery 10 yrs ago. Papers were filed. He pays 280.00 monthly for this amount of time. She will not give a divorce for less than 20 thousand. She has lived with two other men since separation. Is this legal? Does he still have to pay the amount stated even though they have lived seperately for so long. Also, the children are almost grown,(oldest twenty). Does she have a case? I think not..I need your opinion.

Re: outdated divorce proceedings

It's hard to provide an answer with the information you provide. Was the $280 as part of court-entered divorce agreement? Was there a separation agreement? For that matter how can you be a fiancee if the "first" wife has not divorced her husband (your boyfriend).

Should you like to discuss this or any other legal matter, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699 but certainly unless there has been a court ordered divorce your fiancee is not free at this time to marry you.

What papers were filed by whom? Pays $280 mo for what? "Does she have a case" for what? If he's married how are you his fiance?
