Legal Question in Family Law in New York

outrageous divorce

Two questions.

Is there any reason for a marriage lasting one year with no mutual children or property to last more than one or two court dates and involve a custody battle over a 10 year old step child that's been assigned a law guardian?

And is there a way to go to a different state or county and ask that judge to transfer the divorce to a different court because the other party is friends with the current judge?

Re: outrageous divorce

If a party (not the lawyer) has a personal relationship with the judge, the judge should probably be "recused" (removed from hearing the matter).

If the parties did not object to the Court's jurisdiction in their Answering papers, it is highly unlikely the case can be removed to another state, after the matter and issues were "joined" and placed on the calendar.

Good luck,
