Legal Question in Family Law in New York
Overturning a child custody agreement
Recently my ex-wifes husband began divorce actions and moved out of their home. They lived together for a few years and were married for approximately 1 year. Approximately 1 month after he moved out I was informed by my son who currently lives with his mother that her first husband prior to our marriage keeps calling and that his mother is thinking about letting him move in with them. Her reason is it's another source of income. This guy will be moving her from Texas. Obviously, I have many issues with this mainly over what it will put my son through. He has been through enough recently and if this takes place, I would want to go to court for custody. My question is--
Do I have a leg to stand on in the State of New York?

I need more information to assess your case. However, the recent divorce and her bringing back her first ex- could amount to the requisite change in circumstances that you need to show when filing a petition to modify custody. Feel free to call me at 212-367-9167 for an appointment. I do not charge a fee for the inital consultation.
