Legal Question in Family Law in New York

How much would I owe?

I was thinking about getting a uncontested divorce. Also can someone please explain what things would mean uncontested divorce? If I fail, what does the judge say about how much money I would owe? I have no children, I own nothing! I bring home $500 a week, but I pay $300 a month for car insurance, I pay $200 a month to one creditor, I pay $200 a month to another creditor, I pay $100 a month to the IRS. What about would the judge say that I owe to her every month. How does he base his decision. Also what do you think I would have to pay every month? She works and has transportation back and forth to work by one of her sons, plus she lives in her sons home and doesn't pay a dime!

Please be sincere

Re: How much would I owe?

If your wife does not "need" support from you, it is unlikely you will be required to pay her support. If she persists in seeking support from you, it is possible the court will order her to pay you; because she is likely to expose her "real" assets (that she wants you to help her maintain).

Please note:

In NY An "Uncontested Divorce" essentially refers to a divorce that the other party does not contest or fight. It generally means there is no dispute concerning money, children, property and other marital issues.

Unlike child support, spousal support is not mandatory; and it is based upon a showing by the party demanding support that, there is a need and the other party has an ability to pay.

stop sounding like a victim, Get a lawyer ASAP, and take action to improve your circumstances.
