Legal Question in Family Law in New York

Who Owns the House?

My husband owned our house prior to our marriage in 1987. I have my name on the deed as well as a remortgage. Is this house still considered his? Or is it ours?

Re: Who Owns the House?

If the deed is in both your names, then you both have equal interest in the property. It is not important at this point that he owned the property prior to marriage, because he conveyed interest to you by adding your name to the deed. Please contact this office to schedule a consultation.

Re: Who Owns the House?

You may be entitled to some interest in the house if you have been paying the mortgage or contributing to the house in some other way. I suggest you consult an attorney to fully explain the circumstances though.

Re: Who Owns the House?

You both own the house as it is in both your names. However, if you were to divorce, he may be entitled to a larger share of the equity.
