why might it be necessary for the parent of a developmentally delayed individual to obtain legal guardianship of the individual once he/she turns 18? ?

He or she acquires the rights of an adult at 18, and the parent can no longer has authority to make many basic decisions. If the individual is not able to grant authority to the parent or other person to make such decisions (through a power of attorney and health care proxy), guardianship is often necessary.

New York provides a special procedure, known as Article 17-A, for guardianship over developmentally delayed individuals. If I can be of further help, please feel free to contact me.
