Legal Question in Family Law in New York

When the other parent lives with their parent.

My 36 yr old ex has lived with his parents for a year. He has not paid any support in that time, nor has he helped monetary at all. He claims he is living off of his parents who received an inheritance. Our support was agreed upon in the divorce papers without going to court. Our child visits 2x a month. Are his parents obliged to take over his current and past due support payments because they are supporting him? If not, what can I do?

Is there a Judgment of Divorce? If so, you should go to the Family Court and file a Child Support Enforcement petition.

You may also wish to have the CS paid through the Support Collection Unit.
