Legal Question in Family Law in New York
Please help, Parental Rights
I was dating a guy for a few months when I got pregnant. He said that he was not ready to be a father and wanted me to have an abortion. I told him that there was no way that I would be able to do that and if he didn't want the baby I was not going to force him to be a part of her life. We agreed that I would not attempt to contact him for support or send pictures or anything of the sort. Now it is five years later and I am married to a wonderful man who knows everything about my pregnancy. He has been a great father to my daughter. Within the past year we filed an acknowledgement of paternity stating that he is her father on the birth certificate and had her name changed. Now I ran into the guy that got me pregnant at the local home improvement store where he now works. I was with my daughter nad my husband. The two of us made eye contact and we both knew who the other was. He immediatly looked at my daughter, this was the first time that he had seen her. I am now concered that he might try to interupt the family that I have worked so hard ot building. Does he have any rights to my daughter having never attempted to make any contact with her for the past five years?

He probably does have some rights
The best thing would be to have your husband adopt with the fathers consent.

The putative father does have some legal rights, that being said I believe that absent certain circumstances ,he will choose not to exercise those rights. If you would like further info feel free to call my office@718-834-0087.
