Parental Rights

I am involved in a custody battle, my wife keeps moving from state to avoid being served.The last time we went to court the judge said he couldnt hear the case because my children were registered in a Georgia school.My kids are now attending new york schools. I have a two parted question first what are my rights as the non custodial parent to obtainning my children school records secondly now that shes in new york how can I make stay here until this case is settled

If you are entitled to copies of your children's medical records as part of an existing Order of Judgment, you can simply file the same with the school and arrange for duplicate mailings of report cards and other materials. If you do not, you should still contact the school and request records. Some schools will automatically provide this information to parents regardless of the existence of a Court order. If the school will not provide the information, you should make this request in the context of your custody proceeding. It is likely that you can commence a custody proceeding in New York. If the proceeding is commenced, you can request an order directing that the children remain in the state until the case is resolved.

Fathers have rights. You should demand acess to all of your children's school and medical records.

You also have rights if the mother moves to defeat your parental rights.
