Legal Question in Family Law in New York

parental rights

My question is i have custody of my 16 month old grandson. I was awarded temporary emergency custody and then was awarded permanent custody. My daughter is the babies mother, she is willing to let my husband and I adopt the baby, the father has not had any contact with the baby since he was born, he has never seen him, does he still have to sign papers for us to adopt.

Re: parental rights

A putative father need not "sign" Consent, for adoption of his child.

But, If the putative father is "known," he must be properly NOTIFIED of the adoption proceedidng, BEFORE the Court will enter an Order of Adoption.

If the father is unavailable; or his location is unknown, then the form and type of "SERVICE OF THE NOTICE," will be set by the Court, per a Court Order, as requested, AFTER a "due diligent" attempt or search.

Good luck,
