Legal Question in Family Law in New York

My parents are in the middle of a divorce and my dad's lawyer stated in the settlement that I can't take out loans to pay for college and that my mom has to pay for college. The problem is that right now my mom can't afford to pay for it fully so I agreed to take out student loans which has a much lower interest rate and are deferred, whereas if my mom takes out a loan, the rate is much higher and it can't be deferred. Is there a way that I can take out student loans without them having any kind of ties to my father? Is it possible to get emancipated from one parent while still be supported by the other?

I'm almost 19, going into my sophmore year of college, and my mom is the one that makes more money.

I know of no court that would enforce such a provision -if a lawyer was dumb enough to render it in writing- and prevent you from going to college . . . get you education be any means . . .
