Whose last name

When the parents are unwed does mother have the right to have the baby have her last name, if the father doesn't want that?

As a practical matter, the mother will sign the birth certificate paperwork at the hospital, and can set down any information she wants, even if the father submits an acknowledgment of paternity. The father may then change the name with the mother's cooperation, or seek a court order to add his name to the child's. Feel free to call our office to discuss your situation in greater detail
