Legal Question in Family Law in New York
Outside Party Filing for Paternity
How does one go about approaching filing for paternity of a child they think is theirs. And was told at beginning of pregnancy that it was but further down the line was told otherwise. Now 18 months later after seeing the child feels there is need to find out. Now another man has signed the birth certificate as well as been raising this child. What are the rights of the one seeking paternity? And what are the possible outcomes of the situation?
There is also concern for the child because the mother and the ''father'' that signed the birth certificate are no longer together. And the mother is now engaged in a homosexual relationship.

Re: Outside Party Filing for Paternity
If you believe you may be the father, you have the right to file a Paternity Petition in the Family Court in the county where the child resides.
You also have the right to be represented by counsel.
If you wish to discuss this with me privately, please call to schedule a consultation.

Re: Outside Party Filing for Paternity
You can file a paternity petition claiming that you are the father. There are certain presumptions in the law about the parents of a child, but your petition will probably result in a blood test to sort the issue out. Further delay on your part could adversely affect the outcome. This is a complicated situation with the other "father" out of the picture and the mother's current situation.
