Legal Question in Family Law in New York
for the past 4 years my sons father has been paying what he wants when he wants for childsupport. he also post dates my checks and purposley does not sign them to make my life difficult. I sent in the court papers today to take him for childsupport and now he will not pay me anything at all. He keeps threatening me that he is going to have his boss pay him under the table so he does not have to pay me anything in childsupport. My main question is, is he going to be able to get away with this or is he still going to have to pay me based off what his W2 forms?????

Understand, court ordered child support has been around for many years and non-custodial parents have attempted to get out of child support or threatened to do what your child's father has threatened for as long as it has been around. You need to sit down with a family law attorney and map out a strategy to make sure your child gets the support that they deserve and have a right to. Remind your sons father that this money is not for you it is for his son. The court will require your son's father (and you) to produce w-2's, last years taxes, several recent pay stubs and other financial documents for the court to use to determine his gross adjusted income.

He cannot just hide his income. If he lies to the court about his actual income, he will be committing perjury, which is a crime.
