Legal Question in Family Law in New York
Paternity on birth certificate
My daughter is expecting a child and wishes to give the child her boyfriends last name. He is not the father but is willing to take on that role. She will be moving to Delaware after the birth so will be without medical insurance until she starts work there. The baby would be covered by her boyfriends insurance if they handle things this way. They are also hoping to avoid a later legal issue and subsequent fee for changing the baby,s name when they marry. Are there legal problems associated with this?

Well...the father might have some problems with this scenario. Is he aware of the pregnancy? If he is not, informing him of the situation and the mother's plans may save some legaltrouble down the line.

There are always potential "legal" and other problems connected with a lie.
However, it is not your call. You should leave your daughter to her own devices..., she will have to live with the consequences, good and bad.
Accept whatever decision she makes concerning her life and child. Do not make waves or tell her confidences.
GOOD LUCK,
