Legal Question in Family Law in New York

paternity testing

A girl is taking me to court for a paternity test. The conseption date was December, but the last time I was with her was in November. Do I have to take the test? What kind of rights do I have?

Re: paternity testing

In a Paternity proceeding in Family Court the purpose of the testing is to exclude - show that you are not the father. While all you need is to have sex one time, maybe the test will show that you are not the father. If you do not take test then there is a presumption that you are the father. If you are established as being the father

( by law ) then you will be obligated to pay child support until the child turns 21 or is emancipated.

This will be 17% of your adjusted salary - Gross less FICA , Medicare and NYC tax. You also have rights to seek both custody and visitation.

Lastly if you get papers make sure you respond as you could loose by default and may also have a warrant issued for your arrest.
