Legal Question in Family Law in New York

Who pays for custody cases?

My stepson is 14. He has lived with his mom for 14 years and is fine. He wants to continue to visit his dad, but does not want to live there. His dad is likely to try for custody anyway. We don't think he will win. But who will pay thelegal fees for the case?

Re: Who pays for custody cases?

Why this question, when the answer is obvious. The person who WANTS something, payS for it. So, the persons who files or initiates a Motion or Petitions for custody modification, would be responsible for paying their own lawyer and whatever additional costs for social workers, psycho social reports, etc., that may be necessary. A custody proceeding can be very costly, even when the child agrees to the proposed change.

Also, the Court will appoint an attorney to represent the child, that the Petitioner will have to pay for, as well.

Good luck,
