Legal Question in Family Law in New York

Pention and Child Support

Hi, I was wondering if I still have to pay child support and have NY State send my exwife her percentage of my pention after my retirement (in Feb. 2010)? Childrens ages now are, 16 (in high School) and 18 (in College). They will be 20 & 22 yrs old when I retire. My eldest should be graduating college 4 months after I retire.I don't beleive my youngest will be attending college.

Thank You in Advance

Re: Pention and Child Support

Child support obligations are set in one of two places: the court orders accompanying your divorce, or your settlement agreement. The term of your obligation to pay support will be defined in one of those two places (if not stated in both).

Retiring does not alter the terms of the order or the agreement.
