Legal Question in Family Law in New York

permanent order

what would abolish a custody/visitation permanent order dated feb 26 2002? i am trying to violate the mother for denial of visitation. she recieved an order to show cause changing visits for me after i filed for custody. law guardian says i still have all rights in the permanent order that only visitation has been modified. the mother claims her lawyer says because we lived together after the permanent order was signed it is no longer yet everything we both have filed against each other recently is based on that order. she is probably talking crap but would there have to be an official document stating that the order was dismissed? what if any conditions would dismiss it and where can i verify it? been looking at the law library in town but no luck yet what publication can i verify the answer at? thanks

Re: permanent order

Something doesn't sound right. A court order is effective until it expires by its terms, is modified or duly vacated (by the same court or reversed on appeal, for example). The law guardian does not represent your interests, so you cannot rely on him/her to advise you (any more than you can rely on the mother or her attorney). Contact an attorney immediately and be prepared to show all of the court papers. Feel free to call me at 212-367-9167; I do not charge a fee for the initial consultation.
