Legal Question in Family Law in New York

Personal Property Dispute

My ex-bf and I bought a couch while we were dating that I kept when we broke up. He put it on a store credit card in his name and then when we got our taxes, I wrote a check and paid the whole thing off. He is now trying to get me to pay him $1000.00 for the couch; we paid $2500.00. We also bought other items that he kept such as computer, bed, and a car that I made payments on from my personal checking account. I don't think I should have to pay him money for a couch I kept when I paid for all of the things that he got to keep. Going on the same logic, he should then have to pay me money back for the items he kept. Legally I can prove I made payments on all of these things based on my checking account history. I don't want any of those items or any money from him; I just don't want to have to give him anything! Will this hold up in small claims court? Do you think I will have to owe him the money, or will the court rule in my favor? Please give me any advice you can!! Thank you.

Re: Personal Property Dispute

Anything can happen in court. This is not an equitable distribution case however. It is unlikely (but not impossible) that the court will find in his favor. You might seek arbitration (non binding) and that might settle the issue for you.

Good luck
