Legal Question in Family Law in New York

I am planning to relocate to Florida next year. My current husband has already relocated to Florida from New York. I have a child in common with my husband. However my oldest daughter is from a previous relationship (never married) in which we share joint custody. My oldest child's father is pessimistic at the idea of me relocating with both my children and joining my husband. He in fact has told me that he will want me to allow her to reside with him in NY if I move. When the time nears, what are the legal measures must I take, so that I'm legally covered?

You would have to file a petition in Family Court to allow the move.
