Pre-Nuptial agreement

I will be marrying next month. My future spouse and I are both in our middle 40s. I have never married before and she has been divorced twice. She has two children; both are adults. I am a US citizen and she is a non-resident alien in the US. Once married I will be sponsoring her for legal residence in the US with the INS, (but my question is not about this aspect). My position grosses me about $80K/year. She is a domestic. I was informed that because of NY state law a pre-nuptial agreement would be of no advantage to me because of our different pre-martial economic differences. Even with a pre-nuptial agreement, NY state law would protect her. Please render any comments. Thank you.

Whoever told you that you could not protect yourself with a pre-nuptial agreement mis-informed you. You can protect your assets.
