Legal Question in Family Law in New York

Is property inherited intestate separate property? I see that bequests, devises, and descents are separate, but bequest and devise suggests a will was involved and thus testate. So I am wondering if acquiring property INTESTATE is separate property under DRL 236(B)(1).

Property received as a gift or intestate is deemed separate and not marital property.
