Legal Question in Family Law in New York

Husband and I divorced in 1994. Agreement states I agree to accept $6,000 for my distributive share of husband's 401(k). Said transfer will be provided, if feasible, by QUADRO order prepared by Husband's attorney for "rollover" to an IRA account in my name. I assumed this was to take place upon execution of the final divorce agreement recorded December 28, 1994. To date I have heard nothing about this. I have had no contact with my ex since August of 1995. I called his lawyer to inquire about this in 1995, but received no information from his secretary (she said ex had to inquire about this). I have learned that my ex will be remarrying. How do I go about getting this part of the agreement fulfilled and receiving this $6,000? Or is it that this transfer does not take place until ex retires in 15-20 years (he is 44 years old)? Since I am entitled to this money, I would like to establish my retirement savings now.

You are entitled to receive your distribution. Accordingly, you should speak with the attorney who represented you in negotiating the agreement. At this point, I would venture a guess that your $6,000 interest in the 401(k) has increased substantially in value.
