Legal Question in Family Law in New York

This question is regarding child support. I am the non-custodial parent. My ex and I made a child support agreement outside of NY state guidelines for me to pay $900 a month in support, its not based on percentage or salary. My divorce was finalized in 2009. My sons ages currently are 19, 14 and 13. My questions is in regards to the 19 year old. He is not in school and works two jobs and received health benefits from one of the jobs, also he pays my ex $500 a month in rent to stay at her house. Based on my son supporting himself does my support go down? There's nothing in my agreement about this so do I have to pay $900 until my youngest son is out the house?

Thank you,

Michael McCants

You may try to modify your child support obligation if you can prove that he is emancipated. Consult an attorney.

The laws changed 2 years ago regarding modification of child support. You should have an attorney look at your written agreement.
