Legal Question in Family Law in New York
please help
question: My ex husband and I are legally divorce.. I have full custody of our son and he has visitation rights.. The thing is that he is always bring my son home late (not the time that is on the divorce)
and he also yells and cussing me out when i tell him about our son coming home a certain way, eg. my son came home is raggs (his clothes had holes) and also my son went by is dad with a sight cough and came back home bearly talking (his voice was gone)... i dont like when he yells, cuss and go against the rule about bring our son home on time... what should i do? I want him to understand that i am the one taking care of our son and he should threat me with respect.
please help me

Honestly i dont mind if he bring home our son one hour after the time stated on the divorce, but no he want to bring him home so late and its on a sunday and my son has to get up early on monday to go to school he is only five years old .. its not fair .. because my son will be so tried that he cant get up monday morning.. what should i do? I want to put my foot down.

Document the times he is bringing him home. Do not speak to him about it directly but speak to your lawyer about it so that it can be further documented.
If he brings the child home more than 1 hour late make a report to police about it so that it is documented.
You can also document it using a video camera in which you speak in front of a TV so as to cover the time and that the child is still not home. Then film when the child comes home. Do not engage the idiot in a yelling match. Document the returns and go back to court. Ask for supervised visits after that. He will get the point.
