Legal Question in Family Law in New York

hello i have a question well i use to live with the father of my child till he kicked me out now im staying with my sister sleeping in he leaving room the baby has her own crib/ sleeping area but im feeling a little crowded so i might have to leave to a shelter if he take me to court for custody would he win if i go to a shelter?

The first step you should do is seek child support. With child support, it is likely you will be able to afford housing. However, if you go into a shelter, and he wants custody, he may have grounds to obtain custody (with everything else being equal).
