Legal Question in Family Law in New York

Question? My wife and I have been married for 16 years. I am a musician and also do trade work. My wife is a practicing psychologist with a private practice. When we met I was in the process of shutting down a painting and wall covering business had started 11 years earlier also I was caring for my two children from a previous marriage. I had become completely burned out with the Painting & Wall Covering business and wanted to spend more time writing music and performing. She was practicing psychology with a local psychology group but wanted to start her own practice so she could have the most flexibility in her life. We eventually got married and invested in some income property. At the time it was a good situation I took care of the building maintenance and kids 5 & 7she took care of the money. Eventually we had a child sold the properties and invested the money in a new home and a scuba diving wholesale business. We started the business in 2001 and housed it out of our home. All the while since I was primarily operating out of our home with everything I was involved with I by default became the stay at home dad and took care of the kids. My wife acquired an office in a professional building. It�s now 2011 and seems as though we are heading for divorce. I�m 55, after the scuba business failed I started work at a construction company as their coating applications manager. I was laid off in 2009 after about one year of employment due to the down turn in the economy (the whole company shut down)and have not been able to find work since. Again during this time I was delegated as the stay at home dad to care for our children. My economic outlook is not very good right now . I want to know if men in my situation are ever awarded alimony in divorce cases, and if yes, do you think based on this description I would be a good candidate for it?

Yes, there is a good chance. Under the new divorce law, there is a presumption that the "moneyed" spouse (i.e. your wife) will pay spousal support to the other. She may also have to pay your legal fees should the case become contested. Of course, it would take much more analysis and discussion to determine whether you have a good case for alimony/legal fees.
