Legal Question in Family Law in New York

Recently, my mother moved me across the country, seperating me from my father, who i would prefer to live with. The two technically are engaged in both joint physical and legal custody, but this is not actually the case. My mom proudly takes every matter into her own hands, in such a way that is detrimental to my living arrangments and against my wishes. Im 13, so I'm not sure how much my personal opinion accounts for in court, but I would like to move back to my former residence and gain the primary custody of my father, and occasional holidays with my mother, if possible. I moved around 5 months ago, and at the time of court decisions i was relatively impartial to the decision. How might I go about getting my father furthered in custody rights?

Other Facts To Consider:

In my new state, I'm currently enrolled in a private school, of which my mother has paid 46K in tuition, and to both my parents returning to a public school is out of the question.

My mother has a higher income, (she works as an investment banker) but my Father's income is comprable (he is a lawyer)

There is no history of domestic abuse in my family.

I strongly prefer to live with my mother.

Your father can request a change in custody and a law guardian will be appointed by the Court so that your opinion can be considered.
