Legal Question in Family Law in New York
I recently became the non custodial parent of my eleven yr old son (he now lives with his dad). My ex husband has been paying child support through the collection agency and we will need to stop it. I believe it would be a support petition for a modification? My ex husband has verbally agreed on a child support amount from me which is less than 17% of my pay. Will the court automatically take 17% from me because we are in the system? Can my ex husband agree on paper, on the said amount and that would suffice??? Thank you

If your husband will agree to less than 17% then I strongly urge you to get a court order to that effect. Any written agreement would need to be prepared by an attorney and would have to be drafted in the proper form. Otherwise, you run the risk of having the court disregard your written agreement.
