Legal Question in Family Law in New York
Refusing Grandmother visitation
I just received a summons today that my son'd grandmother is taking me and my ex(in Iraq) to court to get visitation. My son hasn't seen him in 11 yrs. I was generous enough to give her visitations until recently when I found out that she was making him talk to his bio. father and sending him letters that he missedand loved him. I also found out the she was giving my son not only his ADHD med but also hers on top of his. She has not followed my wishes on the religion either. my question would be do I legally have the right to remove the visitaions? I feel that it is in the best interest of my son. I feel that she wants visitations with my son so her family doesn't abandon her because he would be the link to keeping her family somewhat together.

Re: Refusing Grandmother visitation
The question of grandparent visitation is a grey area in the law. Currently, grandparents do not have an absolute right to visitation. I your case, you have a good case where you were allowing visitation but she was not respecting your wishes and you think that cutting off visitation is in the best interest of your child.
I would retain an attorney to represent you so that you can place the arguement before the court in a way that will conform to the law and give you the best chance of prevailing in this matter.
