Legal Question in Family Law in New York

register the business

Hello! Please help me with this question: I got divorced, by settlement I gave my ex the business (the only source of income) & she needs to pay me some money in several years.I pay child support and I want to open a new business in the future, the problem is I cannot put it on my name because my ex-wife will sue me for more child support, that's for sure!!!!

Question:

Is it possible to open a business on my brother's name who is not a sitizen & doesn't have a green card, but has a visa to US for 10 years and lives permanently in Israel.

Thank you in advance.

Re: register the business

There is no bar to your brother owning a business in the United States. However, the commencement of a new business after your divorce is not ordinarily grounds for a revision of child support, unless that new business is designed simply to siphon off the customers from your previous business, or something along those lines.

Re: register the business

Your brother can establish a business in USA. Just opening the business will not immediately entitle your ex-spouse for revision of child support.

Furthermore, there are a few possibilities where your brother can obtain some sort of employement visa or green card if he establishes a business in USA.

You can contact our firm if you need further assistance.
