I am relocating in March and wanted to know what I should do prior to leaving in regards to preparing for divorce and child support

It is impossible to answer your question based on a single sentence.

Before moving, you should find out what your rights and obligations are for a relocation, whether or not the relocation will be contested or not, the jurisdictional issues for the divorce, custody and child support, and the financial aspects of the division of marital property.

I suggest you speak to a lawyer in a confidential setting where all of the relevant facts can be discussed.

That's a question that can't be answered without more knowledge of your situation. You should consult a matrimonial attorney with whom you're comfortable, and discuss the specifics of your case.

Re: Relocating before divorce

It would depend on to where you are relocating.

If you are relocating to a nearby state (where you can return to NY for court with no difficulty) then you can still file for divorce in NY.

To where are you relocating?

We also have an office in NJ.

Sincerely,

Patricia Martin-Gibbons, Esq.
