Relocation of child

I currently live in upstate New York and have joint custody/full physical custody of my nearly four year old son. His father has every other weekend visitation. I wish to relocate within state to Long Island to obtain my bachelors degree and I will be remarrying someone who is relocating there for work. This move would offer a family life for my son, and offer him more opportunities in education. I am more than willing and to keep up current visitation and offer more week periods of visitation. My future husband is financially able to afford the expenses involved with the travel for maintaining visitation. My ex will not concent. How can I make this work? The judge who we spoke to in a pre-court hearing has said if this goes to court he will not let me leave with my son even in-state. Is there anything I can do. I am devoted to keeping up current visitation and do not see how this will change anything, as his father shows no interest in any visitation other than what is stated in the court order. Please can you help. New York seems very difficult an area to relocate in. Thank you for your time and efforts.

Absent an agreement with tthe father, you will have to litigate and take your chances in court. You will have to show that it is in the best interests of your child to permit you to relocate.
