Legal Question in Family Law in New York

response to motion in divorce

How do you respond to a motion in a divorce case (I am the defendant - to this motion -and no longer have an attorney). We go back to court in 3 days. I will be representing myself, now.

You normally must serve the answer 3 days before the return date which may/may not be the court date (unless the papers state otherwise).

You answer it in the form of an affidavit, in opposition to the relief requested in the motion.

You must oppose every point or it will be deemed admitted.

I suggest you get another attorney ASAP.
