Legal Question in Family Law in New York

My Rights

I brought my house before I was married to my husband and we have two children together along with my two from a previous marriage and two foster children. I would like my husband out of my house due to abusive behavior towards me. If I inform the police then, the BCW agency may remove my children from the house. How can I get him out without losing my children? He doesn't want go!

Re: My Rights

Simultaneous with the commencement of an action for divorce, you should seek an order of protection and exclusive possession of the marital home. This is a complicated procedure and I suggest you consult with an attorney.
