Legal Question in Family Law in New York
Rights against CPS investigations.
I live with my girlfriend part-time, and Child Protective Services were called on her. The case worker asked for my parents address, where I live. Does she have the right to do so? Do we have to give her the information? Can my parents refuse to disclose their information? And, can the case worker give her a hard time if we do so?

Re: Rights against CPS investigations.
During the course of CPS investigations on child abuse/neglect, the CPS workers act as an investigative agency. They also have the power to take children away from their parents.
It is natural and proper for the caseworker to investigate all members of the household, and those that come in contact with the children.
Therefore she has the right to ask the questions, you do not have to give her the information, nor do your parents.
However they could use this as a basis to take the children away.
It is your choice -. if you have any exposure, I would not give out that information. - but your girlfriend may have problems. Are you the father of any of these children?
