Legal Question in Family Law in New York

Rights Against CPS Investigations-Follow up

Jeffrey A. Lazroe, thank you for your quick response. Here's the information i should of included before, No, I am not the father of these children, he is a deadbeat who hasn't paid her a penny in support since she left him years ago. She's being investigated over a false claim of medical neglect, from someone with a grudge against her, that will be proven false as soon as the childrens doctors are contacted. My parents just don't like giving their information out, so i was wondering our rights, because I don't like being walked over because I don't know my rights.

Re: Rights Against CPS Investigations-Follow up

since you are not the father of these children, you do not have to do anything.

If the charges are found to be untrue, the case ends and everything is expunged from the record.

if the charges are found to be true, she only has a certain number of days to contest it. She should act fast.

If the charges founded are serious enough you and the mother could be charged in Family court with neglect or child abuse, or in a criminal cour.

At this point there is nothing to do but wait to see the outcome of the investigation.

if it should go further please contact me immediately.
