Legal Question in Family Law in New York

Rights To Our Home

My husband and I have unreconsiable diffrences, there is no fixing. We have been together for 20 years, married for 5, he bought our house before we married, he says I have no right to it. We have always lived together, since day 1, I would like to know what my rights are, and what should I do to save my rights? He wants me to move out, and I refuse. There are no children involved, thank goodness, he has had multiple affairs, verbally abusive, physically abusive and so on, I have had it. I don't want to leave my home, he is never here anyway. Look forward to hearing from you.

Re: Rights To Our Home

Although he purchased the house before you were married, the house may have become marital property. I would recommend that you consult with an attorney to evaluate your situation.

Re: Rights To Our Home

The part of the house paid for after the marriage is 'marital property' and you have rights. Much of what was paid on the mortgage is clearly yours. the house can be 3/4 his and 1/4 yours.

You are welcome to a consultation for no fee.
