Re: rights of illegitimate children

In NY, custody of a child is determined in accordance with the child's best interests. The birthmother will be asked in the hospital for the baby's name to be placed on the birth certificate. However, the father may petition to change the baby's name to include his own under certain circumstances. The child will inherit from his/her parents only if made a beneficiary in a valid will or pursuant to intestate succession. Feel free to call my office to discuss your particular concerns in further detail. Good luck.
