Legal Question in Family Law in New York
why did I not get any rights to marital home and my name is on the deed
I want to know what to do about my name being on the deed to the home . I was divorced and the judge gave me no marital property,I did get sole custody of my two children. The divorce grounds were cruel and inhuman treatment,Stating I was nolonger involved with giving attention to my husband. He had moved out of the home 1 year prior. My problem is that my name is on the deed and I want to know either how to get it off as this is affecting MY credit history or what rights I have to getting money such as forcing him to sell the home. I would choose to make him sell it and give the profits if any to my children as he has had very little contact or monatary giving to these children. I no longer want to be connected to this home and his non paying of the payment thus affecting my credit. I am remarried and this too is not fair to my current husband as it too affects his credit through mine.

Your name being on a deed cannot affect your
credit report. Your name still being on
the mortgage given to buy the home can.
If the Court failed to make any disposition
of the mortgage, an application to the
divorce court requesting a correction of this
situation should be made.
