rules for legal separation

My hisband wants me to sign a legal separation stating that we have lived separately for one year. He did move out for 2 years; however, has lived in the marital home on a part-time basis since 1/08. Can I deny him an agreement based on this point?

I wouldn't. There is nothing worse in s divorce proceeding than the spouse contesting grounds. Save the drama, legal fees and venom for the maintenance and child support portion of the divorce.
