Legal Question in Family Law in New York

If I separate from my husband can my 14 year old son decide who he stays with and would that also allow him to move with me legally out of state? ( Texas)

You son can have a say in where he goes but the court will have a roll unless your husband consents. If your husband contests the divorce and or the custody, the court will decide.
