Separation Agreement

Isn't both parties supposed to be present to sign a separation agreement? My nephew's wife said she is having him served with one but he never read it, signed or or received a copy. What is she serving him with?

Your nephew's wife is NOT having him "served " w/ a separation agreement ("SA").

She may be presenting (serving) him with a SA for his signature. He can choose to sign it or not.

A SA is something that BOTH parties agree to and sign whether at the same time or not. I hope your nephew has an attorney to review the SA before signing.

They do not need to sign it in the same place nor at the same time.
