You should ideally consult an attorney to help you with this. Feel free to contact me. Our prices are usually much lower than other attorneys.

Re: Separation

A separation agreement is just that an agreement between both parties .It includes all rights and responsibilities of both sides. It should be artfully drawn by an attorney and explained fully to both sides before execution. You may contact my office for more information.

Re: Separation

Both you and your spouse must sign for there to be a separation agreement. This means that first you must discuss the separation with your spouse and come to an understanding on how you are to separate the property and debt. The terms of the understanding must be set forth on paper which is signed by both parties and acknowledged by a notary public. The separation agreement must be filed with the County Clerk. After a year living under the separation agreement, you would have grounds to commence an action for a divorce.
