Legal Question in Family Law in New York

Separation

My wife and I have lived apart about ten months. During that time our lawyers have tried to work out a stipulation resolving the major issues of the divorce. She has dragged her feet through the process, and in two months we will have lived apart for one year. Does living apart for one year make it easier in anyway to obtain a divorce in New York?

Depending on who abandoned whom, it may provide an additional ground for divorce or, in none existed before, the it could be the only ground.

Where the parties are unreasonable or are otherwise unable to agree on the terms of the agreement, that is why we have people in black robes.

The judge would then write the agreement; it is called a decision after trial.

Of course, just the process of being served, or having to appear in court, often motivates some people to compromise.
